Suit Alleges Bias in Disability Denials

A class-action lawsuit filed on Tuesday in Federal District Court in Brooklyn says that five of the eight Queens judges are not just difficult, but also biased against the applicants — many of whom are poor or immigrants — and have systematically denied benefits to the disabled by making legal and factual errors.

“They are not calling cases down the middle,” said Jim Walden, a partner at the firm Gibson, Dunn & Crutcher, which is handling the suit pro bono, with the Mental Health Project at the Urban Justice Center, a nonprofit group. “They are being extremely heavy-handed with some of the most vulnerable people you could ever meet.”

If you have worked five out of the 10 years under Social Security before becoming disabled, you will have enough earnings in to potentially qualify for Social Security disability benefits.

For individuals age 31 or less, the requirements are a little different, since such individuals have not had such a long time to work. Honoring the Man who Saved Social Security

Most Americans would not know the name Robert M. Ball, but all owe him a huge debt of gratitude. Starting with Social Security just four years after its enactment, he spent the next seven decades improving and defending the most successful and popular program in the nation's history. Friday, a building on the Woodlawn campus of the Social Security Administration will be dedicated to him, just over three years after his death at age 93.

Mr. Ball was a giant. The longest-serving commissioner in the history of the program, he was instrumental in Congress' enactment of the Disability Insurance program, Medicare, and the automatic inflation protection that beneficiaries enjoy, among many other achievements. Moreover, historians credit him with helping to save Social Security at least four times. The first when he was in his 30s and the program was withering away, in danger of being replaced by welfare. The last when he was in his 90s, and he was Grand Central Station in the effort to derail President George W. Bush's plan to partially privatize the program.

How do I receive the lump-sum death payment after a relative dies?

A lump-sum death benefit of $255 may be paid upon the death of a person who has worked long enough to be insured under the Social Security program. The lump-sum death benefit can be paid upon the death of the insured person even if they were not receiving retirement or disability benefits at the time of death.

A one-time payment of $255 is payable to the surviving spouse if he or she was living with the beneficiary at the time of death OR, if living apart, was eligible for Social Security benefits on the beneficiary's earnings record for the month of death. If there is no surviving spouse, the payment is made to a child who was eligible for benefits on the beneficiary's earnings record in the month of death. If no spouse or child meeting these requirements exists, then the lump sum death payment will not be paid. The lump sum death payment cannot be paid to funeral homes for funeral expenses.

To file for the benefit, call 800-772-1213 and request an appointment for your local office. Depending on where you live, the local office might be in Knoxville, Morristown, Oak Ridge, Athens, or Cookeville. You must file the application for the lump-sum death payment within the two-year period ending with the second anniversary of the insured person's death.

In Most Cases, Social Security Benefits are not Subject to Claims of Creditors

Did you know that according to Section 207 of the Social Security Act, the right of any person to any future payment . . . shall not be transferable or assignable, at law or in equity, and none of the moneys paid or payable or rights existing under this title shall be subject to execution, levy, attachment, garnishment, or other legal process.

To make a long story short. Social Security benefits are protected from claims of creditors. There are a few exceptions, such as payment of back taxes and federally-subsidized student loans, but for the most part a creditor can't touch your Social Security. This is true for Social Security Retirement, Social Security Disability, Social Security Widow's Benefits, SSI benefits, and Social Security Survivor's benefits.

Who decides if I am disabled?

In Tennessee, after you file a Social Security disability claim, the case file is sent to a disability examiner at the Disability Determination Section (DDS) within the Tennessee Department of Health in Nashville.

This individual, working with a doctor who has been paid by the State of Tennessee, makes the first decision on your case.

If the claim is denied and you ask for "reconsideration", the case is sent to another disability examiner in the same office.

Think of it this way: If you got a traffic ticket, but thought the police officer was wrong, you first have to argue your case to the police officer's partner before you get to see the judge.

If a claim is denied at reconsideration (and most Social Security disability claims in Tennessee are), you can then request a hearing before a Social Security Judge.

After hearing your testimony and reviewing all of the evience, the Judge makes an independent decision on your claim.

Little-Known Disabled Adult Child Benefits

In rare cases, a young adult becomes disabled before he or she has earned enough credits while working to quality for Social Security Disability benefits on his or her own.

An adult disabled before age 22 may be eligible for Disabled Adult Child (DAC) benefits if a parent is deceased or receives retirement or disability benefits from Social Security. This is called a "child's" benefit because it is paid on a parent's Social Security earnings record.

The "adult child"—including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild—must be unmarried, age 18 or older, and have a disability that started before age 22.

Are Social Security Disability Benefits Taxable?

In some cases: Yes. This includes Social Security Disability and Social Security retirement payments.

You will soon receive a Form SSA-1099 from the Social Security Administration showing the amount of the benefits (disability or retirement) that you received in 2009. To determine if any of your benefits are taxable, figure 50% of your Social Security benefits, and add all of your other income for the year.

Compare that amount with the base amount for your filing status. For single people, the base amount is $25,000. If one-half of your benefits and all your other income is less than $25,000 none of your benefits are taxable.

There are deductions available for attorney's fees in cases where someone had to hire an attorney in order to get their benefits. Be sure to consult with your tax professional, because everyone's situation is different.

With losses of jobs, many people file for Unemployment Benefits, while others turn to Social Security Disability benefits. A few do both. Here are some tips:

1. To receive unemployment in Tennessee, you must certify that you are READY to work, ABLE to work and LOOKING for work.

2. To receive Social Security Disability benefits, you must certify that you are UNABLE to work.

A person cannot have it both ways. If you elect to receive unemployment, you cannot claim to be disabled at the same time. In my experience, the Social Security judges take a dim view of people who take unemployment benefits, then ask for disability benefits at the same time. The Judges believe someone who does that is either lying to the State, or lying to the Federal government.

From time to time, a client whose case we have already won will call and tell me that their doctor has diagnosed them with a new condition that they did not have before and things are worse. They want to know, "Can I get more Social Security Disability benefits?"

The answer is "No." Think of Social Security disability benefits like a light switch. It is either on or off. There is no dimmer. The benefits you receive are tied to the amount of work and taxes you have paid over the years. Generally, the more you work, the more you earn, and the more taxes you pay over the years, the more you will receive in Social Security disability benefits.

What is this going to cost me?

I get lots of telephone calls from people with Social Security Disability claims who are worried about the fee for an attorney. In most cases, my client and I both sign a Fee Agreement. No fee is owed unless we win your claim for Social Security Disability or SSI benefits.

What can I do to improve my chances of winning my Social Security disability claim?

First, be honest and complete in giving information to Social Security about what is disabling you. Many claimants, for instance, fail to mention their psychiatric problems to Social Security because they are embarrassed about them. In almost all cases, individuals who were slow learners in school fail to mention this fact to Social Security, even though it can have a good deal to do with whether or not the Social Security disability claim is approved.

Second, keep appealing. Most claims are denied in the early stages. Many people who have good claims give up. Don't give up.

Most important, hire an experienced person to represent you. It is important to hire an experienced person who understands the way Social Security works. Statistically, people who employ an attorney to represent them are much more likely to win than those who go unrepresented.

Anderson Admitted to U.S. Supreme Court

On June 4, 2007, I had the privilege of being admitted to practice before the Supreme Court of the United States in Washington, D.C.

I am a member of Phi Alpha Delta Law Fraternity, and the first Monday in June is reserved for members of PAD to be admitted to the Court. Three of the current Justices are members of PAD.

No cameras are admitted inside the Courtroom, but here is a photo of me inside the John Marshall room which looks out onto a beautiful courtyard. About 25 other PAD members were admitted that day.

After Court was concluded, Chief Justice John Roberts, Justice Stephen Breyer, Justice Samuel Alito, and Justice Ruth Bader Ginsburg spoke to the members. You can read about all of the Justices here.

Former U.S. luxury restaurateur jailed for fraud

NEW YORK (Reuters) - The former vice president of a luxury U.S. restaurant chain with outlets in New York, London, Hong Kong and Venice was sentenced to up to four-and-a-half years prison on Monday for making false insurance claims.

Dennis Pappas, 60, the former vice president of Cipriani USA, which operates the Rainbow Room restaurant in Manhattan, was ordered to serve a minimum 18 months prison and ordered to pay more than $1 million in restitution.

Knoxville not the only city with Disability Hearing Delays

Nearly every day I get several calls from clients who wonder, "has anything happened on my case". Last time I checked with the Office of Disability Adjudication and Review, there were approximately 4,300 cases waiting to be heard. That's 4,300 people who are out of work, and running short of money.

Today, Joe shows me statistics from a recent NOSSCR newsletter, showing that the Knoxville office actally has more than 5,000 cases waiting for Social Security Disability hearings.

Imagine being at the bank with 5,000 people in front of you. Now imagine that the customers problems are very complex and that the bank staff can only handle 10-12 per day. The staff works as hard as they can, but the people just keep lining up.

Here is an article from the Cleveland Plain Dealer that sheds some light on the subject.

For nearly two years, Terry Van Gieson had to wear a plastic bag, like a diaper, around his stomach to collect his body's waste. He has other troubles, too. Numbness in his legs makes it difficult to walk or stand for long. He's diabetic. And recent surgery for his intestinal problems has him back in the hospital.

But his biggest worry is his Social Security disability check.

He can't get one, even though he paid into the system for 20 years while he worked. Twice, the government has told him no. He's not sick enough.

He appealed the decision in December 2005.

Ever since, the 41-year-old security guard from South Euclid has been waiting to see an administrative law judge in Cleveland to plead his case. In the meantime, he has sold his belongings. He lives off food stamps, $115 a month in welfare and a girlfriend who has gone into debt supporting him. And he's hoping for his day in court.

More than 12,600 other people are waiting with him, according to numbers from the Social Security Administration. That's just to get a hearing in the Cleveland office, which handles cases from throughout Northeast Ohio. Of the U.S. Social Security Administration's 140 other hearing offices across the country, only six have bigger backlogs and one is in Columbus, according to 2006 Social Security data provided by the National Organization of Social Security Claimants' Representatives. The professional group is for lawyers and paralegals who help those filing for disability.

What do I do if Social Security denies my claim for Social Security disability benefits?

Don't be surprised. but DON'T GIVE UP! In Tennessee, only about 1/3 of those who apply for Social Security Disability or SSI benefits are approved at the first stage.

If you are denied, you should appeal. Many people give up and lose benefits that they should have.

You should also hire a competent lawyer to represent you. Make sure your case is evaluated personally by an attorney--not by a paralegal or clerk. Additionally, you should know that there are many people who try to represent Social Security claimants who are not attorneys. Although they may mean well, they aren't held to the same high standards as attorneys, and cannot appeal cases through all steps of the Social Security Disability and SSI claims process.

Social Security Disability Recipients and SSI recipients should stay away from "payday" loans.

According to the Center for Responsible Lending, payday lenders cost American families $4.2 billion every year in predatory fees.

It's appalling, but the minimum charge for these loans, fifteen dollars per $100, equates to a 390% annual percentage rate, or APR - that's multiplied by 26 paydays! Incredibly, only 2.5% of payday lending chains' customers stop at just one loan. Most customers average 5 to 10 loans - up to a 1,800% APR.

Payday lenders won't hesitate to loan to people getting Social Security disability checks.

It can be tempting for people waiting for Social Security Disability benefit or SSI benefit hearings to borrow money from one of these "cash advance" or "payday loan" services. It seems like these places are on every corner in Knoxville and other parts of East Tennessee. Any lawyer will tell you, "it isn't worth it."

Here is an article that ran recently in the Charlotte Observer. It looks like their waiting times for Social Security disability benefit hearings are even longer than the ones here in Knoxville and other East Tennessee hearing offices.

Since 2002, the backlog of Social Security cases has ballooned from 468,000 to 730,000, said Thomas Richards, executive director of the Federal Managers Association, which lobbies for government administrators.

Who decides whether I am disabled?

In Tennessee, after you file a Social Security disability claim, the case is sent to the Disability Determination Section of the State Department of Human Services in Nashville.

This individual, working with a doctor, makes the initial decision on the claim. If the claim is denied and the individual requests reconsideration, the case is then sent to another disability examiner in the same office, where it goes through much the same process.

If a claim is denied at reconsideration, the claimant may then request a hearing with an Administrative Law Judge who works for Social Security. In Knoxville, these judges are at the Office of Disability Adjudication and Review, located in the First Tennessee Bank building downtown. The Judge makes an independent decision upon the claim. This is the only level at which the claimant and the decision maker get to see each other.

For nearly 20 years — ever since Pete Costello was 8 — his mother has collected disability benefits on his behalf. In meetings with Social Security officials and psychologists, he appeared mentally impaired and unable to communicate. His mother insisted he couldn't read or write, shower, care for himself or drive.

Pete Costello sat in court Tuesday, saying nothing, but showing no outward sign he is mentally impaired. He works as an auto-body repairman and lives with a girlfriend and two of her children, prosecutors said.

Social Security system frustrates local resident

This story ran today in the Carlsbad Current Argus, out of Carlsbad, New Mexico. Apparently, folks there have the same problem that folks here in East Tennessee do when applying for benefits.

Last year, [Robert] Johnson was diagnosed with Amyotrophic lateral sclerosis, also known as Lou Gehrig's disease. ALS is marked by gradual degeneration of the nerve cells in the central nervous system that control voluntary muscle movement.
He's applied for disability, but the federal agency has concluded that he can still work. He knows he's not alone, but is frustrated with a system he feels seems to make its decisions based on the number of functioning limbs instead of on specific circumstance.

I think that if Mr. Johnson hires an attorney and follows his attorney's advice, that he will win his case.

Why Does Social Security make it so hard for me to get my own money back?

Actually, when you file a Social Security disability claim, you are not trying to just get "your own money" back. If you are successful, the benefits you can receive will be much more than you ever paid in.

The money we pay in is like the premium for an insurance policy. Everyone who works pays in a small amount. Very few people become disabled, but the money paid in by everyone goes to pay a few unlucky folks who can't work.

For example, a 45 year old worker who pays in an average amount to Social Security over the years might receive, say, $ 1,200.00 per month in cash benefits if he becomes disabled. From age 45 to age 65, assuming his condition does not improve, he will receive $ 288,000.00. That does not even figure in cost of living adjustments (COLAs) or the value of Medicare Health Insurance and Prescription Insurance Benefits.

Crime Doesn't Pay

THOMAS BURNS, 56, and MATTIE BURNS, 52, of Marshall, Texas, have both been indicted for Theft of Government Property in excess of $1,000.00 and Concealment of an Event to Secure Social Security Insurance Disability Benefits.

The indictment alleges that from November 8, 2001 through March 24, 2005, Thomas Burns concealed employment with companies called Jessie Oil Field Service and Dan Blocker Petroleum with the intent to fraudulently secure payments from the the Social Security Administration.

If convicted the Burns each face up to ten years in federal prison and a $250,000.00 fine.

DAVID KEGLEY, 55, and MARION KEGLEY, 61, of Tyler, Texas, have both been indicted for False Statements for Use in Determining Disability Insurance Benefits. The indictment alleges that on September 20, 2004, David and Marion Kegley both made false statements and representations to the Social Security Administration for use in determining rights to Social Security Disability Benefit payments. Specifically the indictment alleges that they both stated that David Kegley had not worked since 1988, when in fact they both knew that David Kegley had done work for "Homes by Greg Langley" from 1994 through 2000 and for "Terry Blevins Homes" from 2002 through 2004.

If convicted the Kegleys each face up to ten years in federal prison and a $250,000.00 fine.

It is important to note that an indictment should not be considered as evidence of guilt and that all persons charged with a crime are presumed innocent until proven guilty beyond a reasonable doubt.

The Social Security Hearing Office in Knoxville scheduled cases for two of our clients today. Both clients Request for Hearing was filed in June 2005 and both cases are claims for Social Security Disability Benefits. How can I tell if I will be found disabled by Social Security?

Unless the condition causing your disability is something catastrophic (terminal cancer, blindness, paralysis of both legs, etc.) there is no easy way for you to tell whether you will be found disabled by Social Security and win your case.

Whether or not you apply for Social Security disability benefits should not be based upon whether or not you think Social Security will find you disabled.

At Cannon & Anderson, we are familiar with Social Security disability and weigh a lot of factors when deciding to take a case, but even then we can not be sure. There are no guarantees in a Social Security Disability case.

Instead of wondering if you will win, make your decision based on your own belief about your condition. How Tennessee rejects more Social Security claims from the sick and disabled than any other state

This interesting article ran recently in the Nashville Scene. It talks about the trouble that people in Tennessee have in getting their Social Security Disability benefits, and why many people find themselves needing a lawyer to get the Social Security disability benefits that they deserve.

About three-quarters of initial claims are rejected annually in Tennessee, creating a backlog of cases. That high rate of rejection, combined with an increase in disability claims in recent years—in part because of the aging baby-boomer population—has created a bottleneck in the system, forcing claimants to wait up to 18 months before their cases are heard.

Given that Tennessee has long been notorious for performing poorly in its role of deciding who should receive the federal benefits, many local attorneys who specialize in such cases say they aren’t surprised. The federal government bestows this responsibility on the states, which operate federally funded offices called Disability Determination Services. Tennessee’s DDS office is located in Nashville and employs about 200 examiners who review disability applications and ultimately approve or deny claims. Critics say that Tennessee’s examiners have consistently been among the lowest paid in the country, and that the state has one of the highest attrition rates among examiners nationwide, suggesting inexperienced employees and frequent turnover might be to blame for the state’s high rate of rejections.

Vote Tuesday November 7

Tuesday is election day. In Tennessee, one of our Senate seats and all nine of the house seats are up for election. The House and Senate will vote on any upcoming changes to the Social Security Disability program.

In addition, the Governor's chair is up for election, and there are a number of state and local ballot initiatives.

The Knoxville News-Sentinel has published an excellent Voter's Guide. The polls close at 8:00 p.m. Don't squander your most important right as an American. Vote.

My doctor says I am totally disabled so why did Social Security turn me down?

This is a question that Joel and I hear a lot.

Social Security's position is that it is not up to your doctor to determine whether or not you are disabled. It is up to them. They will make their own decision regardless of what your doctor (or your lawyer) thinks.

Usually, though, it is a good sign that your doctor will write a letter or make such a statment on your behalf. That means the doctor will probably support your claim. At Cannon & Anderson we seek out specific evidence about what your doctor thinks you can do, and use this information to help the chances of winning your case.

If you have a letter from your doctor, saying that you are disabled, and Social Security turns you down anyway, call us as soon as you get your denial letter. We can help get the evidence going in your direction.

How do you "rate" your pain?

Nearly every Social Security disability client I see is asked if they have pain. Most do. Usually the next question is, "Rate your pain on a scale of 1-10". The problem is, no one really understands the meaning of the ratings. A person with back pain may have never experienced something as bad and say "10!"

Down the road, a judge might think that person is exaggeraing.

The most important thing you can do for your Social Security disabilty or SSI case is to be honest about your answers. The following ratings come from the McGill Pain Questionnaire, which is used by a number of anesthesioloogists.

0 . No pain. Feeling perfectly normal.

1. Very Mild. Very light barely noticable pain, like a mosquito bite or a poison ivy itch. Most of the time you never think about the pain.

2. Discomforting. Minor pain, like lightly pinching the fold of skin between the thumb and first finger with the other hand, using the fingernails. Note that people react differently to this self-test.

3. Very noticable pain, like an accidental cut, a blow to the nose causing a bloody nose, or like a doctor giving you an injection. The pain is not so strong that you cannot get used to it. Eventually, most of the time you don't notice the pain. You have adapted to it.

4. Distressing. Strong, deep pain, like an average toothache, the initial pain from a bee sting, or minor trauma to part of the body, such as stubbing your toe real hard. So strong you notice the pain all the time and cannot completely adapt. This pain level can be simulated by pinching the fold of skin between the thumb and first finger with the other hand, using the fingernails, and squeezing real hard. Note how the simulated pain is initially piercing but becomes dull after that.

5. Very Distressing. Strong, deep, piercing pain, like a sprained ankle when you stand on it wrong, or mild back pain. Not only do you notice the pain all the time, you are now so preoccupied with managing it that you normal lifestyle is curtailed. Temporary personality disorders are frequent.

6. Intense. Strong, deep, piercing pain so strong it seems to partially dominate your senses, causing you to think somewhat unclearly. At this point you begin to have trouble holding a job or maintaining normal social relationships. Comparable to a bad non-migriane headache, or a bad back pain.

7. Very Intense. Same as 6 except the pain completely dominates your senses, causing you to think unclearly about half the time. At this point you are effectively disabled and frequently cannot live alone. Comparable to an average migraine headache.

8. Uttery Horrible. Pain so intense you can no longer think clearly at all, and have often undergone severe personality change if the pain has been present for a long time. Suicide is frequently contemplated and sometimes tried. Comparable to childbirth or a real bad migraine headache.

9. Excruciating and Unbearable. Pain so intense you cannot tolerate it and demand pain killers or surgery, no matter what the side effects or risk. If this doesn't work, suicide is frequent since there is no more joy in life whatsoever. Comparable to throat cancer.

Be honest and complete when you give information to Social Security.

Some people go to extremes. One judge related a story where a man told Social Security that he could not raise his right arm. Then, at the hearing, the man raised his right arm when he took the oath to testify truthfully. Probably what was true was that the man had trouble raising his right arm. That's what he should have said.

Some people fail to mention their psychiatric problems to Social Security because they are embarrassed about them. Someone who has trouble reading or writing may fail to mention this fact to Social Security.

Besides being honest and complete with Social Security, the most important thing that you can do is just keep appealing and hire an experienced lawyer to represent you. It is important to appeal because a lot of people are denied at the initial level, but approved at higher levels of review. It is important to hire an attorney to represent you because you do not understand the way Social Security works. People who use an attorney are much more likely to win than those who go it alone.

Medicare Notifies 632,000 They Need to Enroll

WASHINGTON - The federal government has told about 632,000 elderly and disabled people they won't be automatically enrolled in a Medicare drug plan next year.

Anybody living in East Tennessee who is receiving Social Security Disability benefits and has qualified for Medicare needs to make sure they are enrolled in "Part-D" as soon as possible.

If you are already qualified, you shouldn't need an attorney to sign up.

With the potential for individuals to save hundreds of dollars annually on prescription drugs, Knox County is launching a discount card program that everyone can join.
And all it takes is either a phone call or a few mouse clicks to get the card.

At a press conference this morning, officials will announce the program in conjunction with Advantage Wellness of America, a privately held company based in Knoxville.
Through bulk participation, the program can offer discounts on many drugs, in a few cases up to 75 percent off.
And according to a search on the site set up for people to download the card, at least 88 pharmacies in the county participate, including CVS, Kroger, Wal-Mart, Walgreens, Sam's and Target, to name a few.
The program is open to the insured and the uninsured, and applies to brand name and generic drugs, said Commissioner Mike Hammond, who last fall launched an effort to get such a program.
The effort was launched after people were cut from the state's _TennCare rolls. And while it is aimed at the uninsured and underinsured, anyone can use what is known as the Knox RX Card.
For those insured, the card cannot be used in conjunction with insurance but can be used on prescriptions outside of one's coverage.
"We've had several participants tell us that the prescription card is saving them hundreds of dollars a year," said AWA official Tim Helton.
There is no enrollment cost, and the card can be printed out online in just a few seconds. For those without Internet access, those who wish to obtain a card can call for one to be sent, or get assistance at any library or senior center, officials said.
Hammond also said that on the card's Web page, users may type in their ZIP code and find nearby participating pharmacies. He also said explanation is available in Spanish at the Web site.
AWA is a separate operating unit of United Networks of America Inc. AWA provides discount health and wellness benefit programs to employer groups, individuals, families and associations.

College Professor and Published Author Is Convicted of Fraud

I enjoy reading about cheaters who get caught. This article appeared in the most recent edition of Eye on OIG.

Based on an anonymous tip to the SSA Fraud Hotline, agents from our Indianapolis Office began an investigation of a woman who had been receiving disability benefits since 1985 for rheumatoid arthritis. Investigation revealed that the beneficiary was a university professor and published author under various pseudonyms, who used her husband's SSN to conceal her work earnings from SSA.
In July 2003, SSA initiated a Disability Review, and the woman denied she had been employed or earned any income while receiving SSA benefits. In November 2003, a search warrant was executed at the woman's residence, and forensic analysis of her computer later confirmed her career as a professor. Additionally, items seized revealed that she had been paid by major book and magazine publishers under her husband's SSN. Ironically, she published several books under various pseudonyms that provided tips on how to benefit financially from government loopholes.

SSA determined that the income she earned using her husband's SSN made her ineligible to receive SSA benefits from January 1999 to February 2004. In July 2005, the beneficiary pled guilty to one count of Corrupt Business Influence and was sentenced to 545 days of home detention, 6 years' probation, 40 hours of community service, and was ordered to pay restitution to SSA of $77,180.

It looks like the OHA staff is hard at work during the week between Christmas and the New Year. We got calls to schedule three hearings today.

Two hearings are set for February 6, 2006. The appeals were both filed in October 2004.

The third case is set for hearing on February 9, 2006. The appeal was filed in early November 2004.

I hear this question all the time. Nearly everyone "knows" someone who is getting Social Security Disability in Knoxville or elsewhere in East Tennessee, but doesn't (in their opinon) deserve it.

Frequently, Joe and I challenge these people to name the freeloader. "Just tell us who doesn't deserve it and we'll help you turn them in." Rarely do we get any takers. Maybe it's all hyperbole.

In any event, I think those few who receive benefits but do not deserve them make it harder for those who do deserve them to get them. Joe and I (and probably most Social Security Attorneys) avoid taking clients who don't have a legitimate claim that they are disabled.

If you know someone who is trying to cheat the system, report them. The SSA has set up a fraud reporting site which is easy enough to use.

Late last week the Knoxville OHA called to schedule another Social Security Disability case for one of our clients.

This one is scheduled for January 31, 2006. We filed this client's Request for Hearing in October 2004. Cases are now being set right around 15 months from filing.

How Soon? An Update

Two of my clients' cases were set for hearing this week. Both hearings will be on 11/15/2005 at the Knoxville OHA.

Client #1's Request for Hearing was filed 9/14/2004.
Client #2's Request for Hearing was field 8/17/2004.

The older case is an SSI only case. I don't know if that has anything to do with the scheduling.

As I see it, the OHA is currently running 14 to 15 months to have hearings scheduled.

Anderson out of Office 9/1/05 to 9/6/05

A close family friend passed away recently in San Jose, California, and Ed is traveling for the funeral services and to support the family.
